1. Introduction

Welcome to Arbitra.org, a platform operated by Arbitra S.A.P.I. de C.V., a Mexican company serving a global audience. Although our headquarters are in Mexico, we are committed to upholding the privacy and data protection rights of all users—especially U.S.-based individuals—in accordance with applicable laws including the California Consumer Privacy Act (CCPA), Illinois Biometric Information Privacy Act (BIPA), and other state-specific regulations. By accessing or using our services, you agree to be bound by these Terms of Use. If you do not agree, please do not use our services.

Arbitra provides independent benchmarking and security testing of identity verification (IDV) technologies. Our services include:

  • • Comparative benchmarking using synthetic and publicly available data
  • • Controlled testing of client IDV solutions using synthetic and consented real user profiles
  • • Publication of performance reports, insights, and certification summaries
3. Key Definitions
  • Services – All tools, reports, datasets, and testing capabilities offered by Arbitra.
  • Benchmarking – The evaluation of IDV vendor performance using consistent, comparative criteria.
  • Synthetic Data – Computer-generated user data, not linked to real individuals, used for safe and repeatable testing.
  • Real User Profiles – Consent-based test records voluntarily submitted by users for controlled analysis.
  • Vendors – Providers of IDV platforms evaluated by Arbitra (e.g., Jumio, Persona, Mitek).
  • User Content – Any data, feedback, or information you submit to our platform.
4. Acceptable Use

You may use Arbitra's services for research, education, and authorized testing.

You may:

  • • View published benchmarking results
  • • Submit your IDV system for evaluation
  • • Participate in controlled testing with consent
  • • Use synthetic datasets under CC BY-NC 4.0 license terms

You may not:

  • • Use our site for unlawful or misleading activity
  • • Republish or redistribute our reports or datasets without permission
  • • Attempt unauthorized access to third-party vendor systems or client environments
  • • Attempt to identify individuals from synthetic datasets
  • • Use automated tools to scrape or collect data from our platform
  • • Create competing services using Arbitra data or methodologies
  • • Violate any applicable laws or regulations
5. Intellectual Property and User Content

Arbitra IP:

  • • All content, reports, and methodologies developed by Arbitra are protected intellectual property.
  • • Synthetic datasets are released under the CC BY-NC 4.0 license for non-commercial use.
  • • Commercial or derivative use of our materials requires explicit written permission.

User Content:

  • • You retain ownership of any content you submit to us
  • • By submitting content, you grant Arbitra a non-exclusive, worldwide license to use it for our services
  • • You represent that you have the right to submit any content and that it doesn't infringe third-party rights
  • • We may use your feedback and suggestions without compensation

Vendor Names and Logos:

  • • Use of vendor names in our reports is for factual identification purposes only
  • • We respect all trademark rights and use vendor identities in accordance with fair use principles
  • • Vendors may request removal of their names through our opt-out procedures

DMCA Compliance:

If you believe content on our platform infringes your copyright, contact legal@arbitra.org with:

  • • Description of the copyrighted work
  • • Location of the infringing material
  • • Your contact information and good faith statement
  • • Electronic signature
6. Data Usage, Consent & Privacy

We respect your privacy and data rights.

  • • Real user profiles are collected only with explicit, signed consent
  • • You may withdraw consent at any time by contacting privacy@arbitra.org
  • • Upon consent withdrawal, we will delete your data within 30 days
  • • Synthetic datasets contain no personally identifiable information (PII) and are clearly labeled. Synthetic datasets may also include hybrid profiles combining real attributes (such as document formats or demographic distributions) with fake or computer-generated elements. These combinations are created for testing realism only and are not tied to actual individuals.
  • • All testing is conducted with documented vendor approval and is securely stored

7. Account Management and Security

Account Creation:

  • • You must be at least 18 years old to create an account
  • • You are responsible for maintaining the security of your account credentials
  • • You must provide accurate information when creating an account
  • • We verify age through attestation and contract validation for real user testing

Account Suspension:

We may suspend or terminate accounts for:

  • • Violations of these terms
  • • Suspicious or fraudulent activity
  • • Non-compliance with testing procedures
  • • Legal or regulatory requirements

Data Export:

Upon termination, you may request export of your personal data within 30 days.

8. Disclaimers & Limitation of Liability

Our services are provided "as-is" for informational and research purposes only. We do not guarantee the accuracy or reliability of third-party data sources or vendor system behavior.

Arbitra is not liable for:

  • • Misuse or misinterpretation of benchmarking reports
  • • Decisions made based on test outcomes
  • • Incidental, consequential, or indirect damages of any kind
  • • Service interruptions or data loss
  • • Actions of third-party vendors or users

Liability Cap: Our total liability to you shall not exceed $1,000 or the amount you paid us in the 12 months preceding the claim, whichever is greater.

9. Indemnification

You agree to indemnify and hold Arbitra harmless from claims arising from:

  • • Your violation of these terms
  • • Your use of our services
  • • Infringement of third-party rights through your use of our platform
  • • Your submission of User Content
10. Third-Party Content

Arbitra may reference third-party platforms (e.g., G2, Gartner, NIST). These are for informational purposes only and not under our control. We are not responsible for the content, accuracy, or privacy practices of these external sites.

11. Force Majeure

Neither party shall be liable for delays or failures due to circumstances beyond reasonable control, including natural disasters, government actions, cyber attacks, or other unforeseeable events.

12. Termination Rights

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for violations of these terms or misuse of the platform.

Upon termination:

  • • Your right to use our services immediately ceases
  • • Provisions regarding intellectual property, indemnification, and liability survive
  • • You may request data export within 30 days
13. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict of law rules.

Dispute Resolution Process:

  • • Good Faith Negotiation (30 days)
  • • Mediation (if negotiation fails)
  • • Binding Arbitration administered by the American Arbitration Association (AAA) and held virtually or in San Francisco, California

Exception: Arbitra may seek injunctive or equitable relief in any jurisdiction where its intellectual property rights are at risk.

Note: Arbitra is a Mexico-based entity. These terms are designed to provide U.S. users with familiar protections under U.S. legal frameworks while acknowledging our international operations.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Changes to These Terms

We may update these Terms periodically. When we do, the updated version will be posted with a revised "Effective Date." Material changes will be communicated via email or platform notification. Continued use of the platform after changes constitutes acceptance of the updated terms.

16. International Compliance

For users outside the United States, we comply with applicable local privacy laws including GDPR where required. Our services are primarily designed for users 18 and older worldwide.
